Practice Guideline 6: Guidelines for arbitrators dealing with jurisdictional problems

I have had some questions and messages around what jurisdiction is. I wish to reiterate it IS NOT and never will be trialling the case. 

It is for clarifying if the ICSID (International Centre for Settlement of Investment Disputes). Now with the utmost respect, if people are unsure of this or do not have a clue, then either continue gambling or sell up and walk away. It is tiring to read childish statements about what is a very simple process. It makes me wonder why people bother investing and stick with horse racing or betting on goat races (aimed at Ian). For that reason, I will not be responding to any other questions or queries about it.

Fraser- Just to assist- I know we are considering CHL here (an ICSID case) but to give some idea re timescales, OXS beat their jurisdiction attempt (a UNCITRAL case) in Nov 2012 and they confirmed they are scheduled to have their trail and decision in 2014 (but possibly not the award, if they win).

    So if CHL have some good news soon (which is expected by most), they may well have a longish wait for the trial, judgement and award process to get into the ICSID schedule. Obviously ROI could make offers to settle early, but we all need to be patient if we are looking for a long play with CHL. I expect late 2015/early 2016 as an end date here but that just me and my research :-))

  2. Thanks Fraser. I stopped reading a lot of boards & cancelled my subscriptions as per your post. I stopped buying and looked at my trading, I also pay for that item with Tom tom Winnifrith you said, its changed my trading hugely and I'm saving 25 quid a month. Thank you John.

Very insightful, you should copy paste your commentary via markets live here its truly outstanding how accurate your calls have been. my first fx trader GBP to AUD was thanks to you. Tom W and shareprophets put forward GLIF that you mentioned might do you some good. Surely tom would be interested in your machiavellianism. rich.

    How can its value appreciate above the method of appraisal. if the same was done rur would get zero as Bolivia wrecked the plant. they do not understand the process @ all !!!!!!!!!!!!!!!!!!!!

    1. Hi Alan, yes someone else sent it to me yesterday and I laughed then. I'm not sure what the person knows of the process but its not a lot based on their statement the value will go up because there's more interest in the region or district. Perhaps that's why these stocks are so undervalued because people don't understand a simplistic process but better still aren't prepared to wait considerable amounts of time.
